The Appellate Division of the Supreme Court has upheld bail granted by the High Court to former Narayanganj City Corporation mayor Selina Hayat Ivy in five cases, including murder cases, filed over violence linked to the July Uprising.
The court today (10 May) also directed the disposal of stay orders issued over her bail in five other cases.
The order was passed by an Appellate Division bench led by the chief justice.
Deputy Attorney General Fatema Akter said the order means Ivy’s bail remains effective in 10 cases.
Barrister Sara Hossain and Advocate Motahar Hossain Saju represented Ivy during the hearing.
Her lawyers said there is now no legal barrier to her release following the Appellate Division’s order.
Earlier, in November last year, a High Court bench comprising Justice ASM Abdul Mobin and Justice Md Sagir Hossain granted her bail in five separate cases, including three murder cases and two attempted murder cases, after making the rules absolute.
The state later sought a stay on that order from the chamber judge of the Appellate Division, which temporarily stayed the bail.
Subsequently, on 18 November, Ivy was shown arrested in five more cases.
On 26 February, another High Court bench comprising Justice KM Zahid Sarwar and Justice Sheikh Abu Taher granted her bail in those cases as well.
Among the cases were those over the murders of bus driver Abul Hossain Miji, Abdur Rahman, Md Yasin and Parvez, all filed at Fatullah Police Station.
Another case filed at Narayanganj Sadar Model Police Station accuses her of assault and obstructing government duties.
The state again challenged the High Court orders in the Appellate Division. On 5 March, the chamber court stayed the bail orders and sent the matter to the regular bench for hearing.
The Appellate Division heard all 10 cases today.
Ivy has also been shown arrested in two additional cases.
The High Court granted her bail in those cases on 30 April, but the state has appealed those bail orders as well.
Selina Hayat Ivy was arrested around 3am on 9 May last year at Chunka Kutir in Deobhog. She was later shown arrested in several cases.
