The High Court has fined GPH Ispat Tk5 crore for concealing the fact that a case on the same matter was pending before the Appellate Division while seeking a fresh order from the High Court. The court also ordered the money to be used for the treatment of those injured during the July Uprising.
A High Court bench comprising Justice Md Nazrul Islam Talukder and Justice Mahmud Hossain passed the order today (29 July). Attorney General Barrister Ruhul Quddus Kazal represented the state during the hearing.
Speaking to reporters afterwards, Kazal said the company had previously filed a writ petition before the High Court and obtained an order, which was later stayed by the Chamber Court of the Appellate Division.
“Despite the stay order, the company filed a fresh case in a lower court and subsequently sought an injunction from the High Court without disclosing the earlier writ petition, the Appellate Division’s stay order or the ongoing proceedings,” he said.
“The company tried to obtain a court order by concealing material facts, which amounts to misleading the court,” Kazal added.
He again added that the petitioner’s lawyers later offered an unconditional apology, saying they had not been informed about the earlier case.
The attorney general said the order sends a strong message against concealing material facts and misleading the court, reflecting the judiciary’s firm stance on upholding justice.
